UPON FILING A MORTGAGE FORECLOSURE, A TAX SALE OR EXECUTION OF A JUDGMENT YOU WILL NEED TO PROVIDE THE FOLLOWING:
- Writ of Execution – Affidavit of Act 91 of 1983
- Affidavit of Last Known Mailing Address
- Notice of Sheriff’s Sale
- Sheriff Form 56 (4 COPIES) provided
- Sheriff Form (ALL CAPS) Brief
- Description of Property to be sold
- Notice of Sheriff’s Sale for EACH defendant, if service is requested & direction form
- Sheriff Form 14 (Direction Form) for each address, for handbill
- Long Description of the Property
- Self- Addressed envelope with postage for each direction form
WHEN FILING A MONEY JUDGMENT, YOU WILL NEED:
Bring everything in the list above as well as:
- Exemption Claim Notice for each defendant and a copy for the Sheriff’s Office
- Copy of the Writ of Execution for each defendant with a self-addressed envelope with postage for each defendant
FILING CORRESPONDENCE
When filing any correspondence concerning Sheriff’s Sales, you must include the sale number and sale date in the upper right-hand corner of the papers or the papers will be returned (IE #21, 7 May 2001)
The direction sheet must have the sale number and the postponement date in the upper right-hand corner, as well. (IE #21, 7 May 2001, PP August)
If you wish to make use of the following online Sheriff’s Direction Forms, please not to receive a Return of Service notification from the Sheriff’s Office. In turn, you must include the following:
- Duplicate Request of Service
- Self-addressed stamped envelope
